U.S. District Judge Appoints Hogan Paschal to the Depo-Provera Products Liability Litigation Steering Committee

Hogan Paschal, an associate in the firm’s Litigation Section, was recently appointed to a leadership position in the Depo-Provera Products Liability Litigation (Case No. 3:25-md-3140) by U.S. District Judge M. Casey Rodgers (Northern District of Florida – Pensacola Division). The Steering Committee includes several subcommittees, and Hogan is one of only six attorneys who will serve on the Law and Briefing Subcommittee. In this role, she will work in consultation with Lead and Co-Lead Counsel, Plaintiffs’ Liaison Counsel, and both the Executive and Steering Committees to plan, research, and prepare pleadings, motions, briefs, proposed orders, and other written materials during litigation. The case centers on Depo-Provera (Depot Medroxyprogesterone Acetate), an injectable birth control treatment manufactured by Pfizer, which plaintiffs claim can cause consumers to develop a type of brain tumor called meningioma. Questions raised in pretrial proceedings include whether Depo-Provera causes meningiomas, whether the defendants were aware of the alleged risk and failed to make a sufficient effort in warning this risk, and whether they neglected promoting safer alternative methods of injection (for example, subcutaneous injections rather than intramuscular). Defendants in this case maintain that the medication is safe.
Fishman Haygood filed a complaint on behalf of its clients beginning in December 2024 before all Depo-Provera cases were consolidated into multidistrict litigation (MDL). In early February 2025, the MDL was transferred to the U.S. District Court for the Northern District of Florida for pretrial proceedings before Judge Rodgers. The court then solicited applications for Plaintiff leadership positions.
